Pontianak – Untuk kedua kalinya, event lari terbesar di Kota Pontianak yakni Pontianak City Run kembali sukses digelar pada Minggu 02 Februari 2020. Ribuan pelari nasional maupun internasional meramaikan event yang bersamaan dengan Festival Buah-Buahan Lokal Eksotika Buah Lokal Khatulistiwa 31 Januari – 02 Februari 2020 di Taman Alun Kapuas Kota Pontianak. Event tahunan ini benar-benar memperkenalkan budaya khas Kalimantan Barat khususnya di Kota Pontianak, mulai pengambilan nomor BIB dan aksesoris Race Pack di Gedung UMKM Center Dekranasda Kota Pontianak, tentunya dapat memperkenalkan UMKM Pontianak sebagai tempat oleh-oleh khas Kalimantan Barat berupa pameran produk UMKM. UMKM Center Dekranasda Kota Pontianak Keistimewaan dari Pontianak City Run 2020 adalah konsep kebudayaan yang diusung sebagai penyelenggara dengan menggandeng salah satu EO lokal yaitu Sporta Kalbar bersama Pemerintah Daerah Provinsi Kota Pontianak dan Dinas Pariwisata dan Kebudayaan Kota Pontianak. Dimana pada kegiatan lari marathon ini, sebagian peserta lari melewati tempat-tempat menarik Kota Khatulistiwa sehingga meningkatkan nilai pariwisata. Seperti Rumah Adat Melayu, Rumah Radangk, Tugu Digulis, Masjid Raya Mujahidin, Gereja Santo Yosep Katedral dan lain-lain. Terkait rute lari, panitia event PCR 2020 bekerjasama dengan pihak kepolisian jadi tidak perlu khawatir di jalur yang bersinggungan dengan kendaraan bermotor atau jalur padat, semua sudah diatur dan diamankan oleh polisi, tidak lupa mobil ambulan yang standby untuk para peserta jika terjadi kendala. Following the success of having more than 4000 domestic and international participants back in February 2019, the Pontianak City Run Half Marathon event will be held on 2nd February 2020 which will be opened for the following categories 1K Kids Race category for children between 4 – below 12 years old or those in kindergarten and primary schools with distance of 1 km. The Kids participants may choose to be acommpanied by either one or two companions or parents. The companions or parents will only receive a Shirt/Jersey. 5K Students Race category for students between 13 – 18 years old or those attending junior and senior high schools with distance of 5 KM. 5K Open The open race category for public, with minimum age of 18 years old, open for both Indonesian and foreign nationals with distance 5 KM. 21K Open The open race category for public, with minimum age of 18 years old, open for both Indonesian and foreign nationals with distance 21 KM. All participants shall meet the minimum age requirement on the day of the race 2nd February 2020 “Race Day”. Participants below eighteen 18 years old on the Race Day are required to submit a parental/guardian consent letter. The letter format can be downloaded here. GENERAL TERMS AND CONDITIONS General Definitions The definitions used in this Terms and Conditions shall have the meanings stated as following except where the context requires otherwise “Event” or “Race” means the Pontianak City Run-Half Marathon 2020. “Registration Fee” is the specified Event participation fee and shall be paid by the Participants to be able to participate in the Event. “Registration Form” means the event registration form, which may be done via “Info Desk” and/or “Hotline” is the division which will provide official information which are managed by Race Management. “Race Management” is the Event race management which is with Event related contacts as following email [email protected] and +62 858-2921-1137 WhatsApp Only. “Participants” or “Runners” mean the individuals who are registered for the Event. “Race Pack” is the official race package issued by the Race Organizer and managed by the Race Management to be handed over to the official participants. Within the Race Pack includes, amongst other, the race number BIB, Jersey/Shirt and/or other Event related materials. “Race Pack Collection Day” means the day of the race package collection for the Event. Complete information associated with the location and time for the race package collection will be communicated in advance to the Participants by the Race Management via the registered Participants’s email address and through the Race Organizer’s official social media page. “Terms and Conditions” mean the terms and conditions or rules and regulations associated with the execution of the Event including the registration procedures and participation’s rules and regulations. “Race Website” is the official website of the Event which is “Registration Website” is the officeial online registration portal managed by the Race Management which link is included in the Race Website. General Conditions All registered Participants shall first read and understand the terms and conditions prior to registering for the Event. It shall be noted that the Participants are the receiving party of the official confirmation email for the Event, who have confirmed their participation as the Participants of the Event, including the party who receives the invitation and free slot from the Pontianak City Run Half Marathon. By registering as Participants in the Pontianak City Run-Half Marathon 2020, the Participants accept in full and shall comply with the applicable terms and conditions. The Pontianak City Run-Half Marathon 2020 is a competitive Event. Both Indonesian and Foreign Nationals may apply for the Race. The Participants run in the Pontianak City Run-Half Marathon 2020 race category 1K Kids. 5K Students. 5K Open. 21K Open Half Marathon. The Race Organizer reserves the right to verify the Participants’ details prior to, during and after the Race, any exemption to this requirement can only be granted when agreed by the Race Organizer. The Race Organizer reserves the right to close the ticket sales/registration when the Race quota is fulfilled. The ticket sales/registration is considered successful when our system has successfully received and verified the Participant’s payment. The Participants are prohibited to transfer and/or perform any buying/selling activities on their Pontianak City Run-Half Marathon 2020 registration outside of the or application. The Race Organizer reserves the right to unilaterally cancel the Participants’ registration should any indication of transfer and/or ticket sales/registration outside of the official registration channel is found. The Race Organizer reserves the right to contact the Participants via telephone or email to collect Event / Race related data. In the event that any unforeseen circumstances occur beyond the control of the Race Organizer, including but not limited to heavy rainfalls, thunderstorms, disasters, social unrests, which renders it impossible or unsafe to hold the Event, the Race Organizer will not refund the paid registration fee and shall not be held responsible for such occurence. This Race carries potential risks including but not limited to physical injury, property damage or other harms and event death. As such, the Participants shall be responsible of their own medical conditions prior to and during their participation in the Race. The Race Organizer shall not be held responsible for any dangers or harms caused by, including but not limited to, the followings The occurence of Risks/Hazards. Participants’ late arrival to the Race. Force Majeure circumstances outside of the Race Organizer’s control as defined above. Property or other damages. The Participants shall wear the official Jersey/Shirt which have been provided by the Race Organizer within the Race Pack and pin the BIB on the Jersey/Shirt. Pets or any forms of wheel-run objects for transportation such as bicycle or wheel chair, skate, in-line skate, roller skate, baby strollers, baby push carts or any other wheel-run objects are not allowed on the Race route. Water station will be provided at various checkpoints, which will be shown separately on the Race map. The Race Organizer reserves the right to stop the Participants from continuing the Race if the Participants are behaving in a manner deemed to be inappropriate to the Race and disrupt other participants or the course of the Event. Security and medical services will be provided by the Race Organizer, in collaboration with the local hospitals and medical personnel. The medical personnel shall be allowed to stop the Participants who are deemed to be medically unfit to continue the Race. Copyright and other intellectual property if any of images, photographs, articles, race records and location information covering the Event and their usage right for TV broadcasting, newspapers, magazines, internet and other media publications shall belong to the Race Organizer. These also include the names and other personal information of the Participants. At anytime, the Race Organizer may modify the terms and conditions in accordance with our policy at our sole discretion without prior notice. Any other provisions which are not yet included in this terms and conditions will be communicated by the Race Organizer in the future when identified. General Information The definitions used in this Terms and Conditions shall have the meanings stated as following except where the context requires otherwise This provision and any documents referred within it constitutes the entire agreement and common understanding between the parties and supersedes any prior agreement between the parties in relation to the Event. The Participants understand, acknowledge and agree that by submitting the Registration Form and any documents referred within it, the Participants do not depend on and not automatically enter into a relationship, statement, guarantee, understanding, promise or other guarantee whether due to negligence or unintentional with any person regardless whether the parties are related to this Provisions or not are expressly regulated in this Provision. Nothing within these Terms and Conditions shall be suspected or considered as a partnership between the parties or one party is considered as the other agent for any purpose and the parties do not have the authority or power to bind themselves or contract on behalf of the other in any way or for any purpose. The Race Organizer shall not be held responsible / liable should the Event becomes disrupted or unable to be carried out due to incidents beyond the control of the Race Organizer and Race Management whether arising from natural causes, human or other causes including but not limited to Natural disasters; earthquake, storm, flood and so on; Fire, vandalism, sabotage, demonstration, riots, strikes, terorism, war and; Changes in the applicable laws and regulations. The provision for releasing these claims applies automatically as Participants are required to read carefully and deemed to understand, submit to and comply with the Rules. Confirmation on statements to comply with the Terms and Conditions can be made in writing if deemed necessary on a separate sheet which will be provided by the Organizer both online and at the Race Pack Collection location. As far as permitted by the law, all these provisions must be separated from and no provisions are affected by the invalidation or non-validity of the other provisions with the remaining provisions if needed, which have been amended as would be required to have the same effect as these Provisions to the extent possible. These Terms and Conditions shall be interpreted in accordance with the Indonesian law and any dispute arising under this Agreement must be subjected to the exclusive jurisdiction of the Indonesian Courts. INFORMATION DISTRIBUTION The Race Organizer will send all communication materials and relevant Event information to the email address supplied by the Participants in the Registration Form. The Race Organizer will send all the communication materials and information on the Pontianak City Run-Half Marathon Event. The Race Organizer shall not be held responsible for any damages to the Participants’ electronic devices which are being used to access the Event’s / Race website or other technical negligence which may occur during the process of sending the communication material and email correspondence which may cause failure in the Participants in receiving the information. The Participants shall ensure and believe that all the information including the email address which is being supplied is accurate and true. AGE RESTRICTION The applicable age restriction per category is based on the Participants’ age on the day of the Event. Minimum age restriction is 4 years old and maximum age restriction is 70 years with the limiting categories as following 1K Kids Run 4 – 12 years or equivalent to kindergarten and primary school. K5K Students 12- 18 years or equivalent to junior/senior high school. 5K Open public, minimum 18 years. 21K Open public, minimum 18 years. Young Participants under 17 years old from 4 years – 16 years are required to provide parental consent by completing the Parental Consent Form which can be downloaded here, signed by the parent or guardian with duty stamp and submitted during the Race Pack Collection. RISKS The Participants are deemed to understand, realize and acknowledge that this Event has risks which can result in physical injury, disability and even death. The Participants guarantee that they are in sufficient physical and health conditions and are mentally and physically fit to participate in the Event and agree to take responsibility for their own actions when participating in the Event. The Participants are suggested to seek medical advices from their medical practitioners with regards to their medical conditions prior to their participations in the Race. The Participants acknowledge and accept that their participation in the Race can bring potential risks and dangers, including but not limited to accidents, physical injury, health issue, disability, death, property damage and/or other loss, and other unforeseen risks “Risks and Dangers“. The Risks and Dangers may occur due to the action or negligence of the Participants or the action or negligence of others, and/or conditions of the facility and/or equipment and nature and/or weather and/or Force Majeure conditions as defined below. The Race Organizer encourages pregnant women to consult with their doctors prior to participate in the Race. The Race Organizer shall not be held responsible for any complication or health issue and/or any other Risks and Dangers which may occur from the Participants participation in the Race during pregnancy. The Participants agree to release the Race Organizer including but not limited to its managements/employees/affiliates, professionals and other parties who are appointed by the Race Organizer and sponsors who are in association with the Race Organizer of any losses and damages which may occur in relation to the Race, with exception if the losses or damages are caused by intentional negligence. The Race will be cancelled when incidents outside of the Race Organizer’s and Race Management’s control occur including heavy rainfall, storm, disaster, demonstration, non-issuance of race permit, or other causes. In the event that the Race is cancelled due to the incidents outside of the Race Organizer’s control, then the Registration Fee will not be refunded, and the Race Organizer and Race Management shall not be held responsible for the loss or inconvenience caused. The Registration Fee will also not be refunded to the Participants who are removed due to security/disorder reasons and/or disqualification. The Race Organizer and Race Management shall not be held responsible for the loss and inconvenience caused by the non-refund of the Registration Fee or Event’s cancellation. The Participants understand that any noncompliance whether intentionally or unintentionally to the Race’s Rules and Regulations can cause the Participants to loose their participation rights. PARTICIPATION CODES OF CONDUCT The Event may be participated by Indonesian Nationals WNI, KITAS holders and Foreign Nationals who bring personal identification in the form of passport. The Participants shall fill all required information within the Registration Form. Should the Participants entered any incorrect data, then the Race Organizer reservers the right to disqualify the Participants’ registration and disqualify the Participants’ right to participate during the Race.. The Participants shall obey all the codes of conduct and all procedures and guidelines being provided by the Race Organizer, Race marshals and security personnel assigned by the Race Organizer. The Participants acknowledge and accept that the Race Organizer will regulate and execute the Event, timing/finish time and the implementation of the Event. All decisions and regulations issued by the Race Organizer in relation to the Event shall be considered final. The Participants are aware of, agree and acknowledge that their participations are of private nature and its rights or obligations cannot be transferred to other parties for any reason. The Participants declare and guarantee that their registration is for personal use only and will not be used for any commercial activities including to be transferred to third party. Any violation on this requirement shall result in disqualification. The Participants shall present their valid personal identification such as KTP, SIM, KITAS or passport in original form or photocopy during the Race Pack Collection. Race Pack Collection can be done by a representative/other person by bringing the softcopy/hardcopy of the successful ticket purchase notification email, copy of the Participants’ identification card and original power of attorney with duty stamp from the Participants. The Race Organizer will not provide any ticket, accommodation and hotel, all costs to be expended by the Participants for their participation in this Event shall be the responsibility of the Participants. The Winners who are entitled to receive winning prizes are the Podium 1, 2 and 3 Winners. REGISTRATION, BOOKING AND PAYMENT CODES OF CONDUCT The Participants and other involved parties are deemed to be aware of and understand as well as oblidged to comply with the provisions within the Terms and Conditions of the Pontianak City Run-Half Marathon 2020 Event “Terms and Conditions” as following The Participants are obligated to Fill the Registration Form via the Registration Website in full and accurate; and Pay the Registration Fee as per the official specified information in the Event website. Grace period between the registration submission and payment shall vary as per the method of payment Gopay payment will be up to 15 minutes, bank transfer up to 24 hours. Registration will be deemed successful upon successful payment or cancelled due to non-payment within the grace period. The Race Organizer will issue registration confirmation in the form of notification email of successful ticket purchase after the Participants have successfully pay the registration fee and officially registered. The Participants are not entitled to transfer their participation. The Participants are not entitled to change the information after the registration confirmation is issued, as such the Participants are encouraged to fill accurate data and ensure that all data are filled correctly. The Race Organizer reserves the right to close registration period when a specified time period has lapsed or at any time when the Race quota is fulfilled. RACE CODES OF CONDUCT The Participants and other involved parties are deemed to be aware of and understand as well as oblidged to comply with the provisions within the Terms and Conditions of the Pontianak City Run-Half Marathon 2020 Event “Terms and Conditions” as following The Participants shall be present at the Race location at least 30 minutes prior to the flag-off. The Participants are responsible to plan for their own travel time to the Race location including travel, parking, baggage drop/deposit bag, etc.. The Parcipants who are late to start beyond 10 minutes after the flag-off for their own category, are allowed to start as per the next start category if the Participants fail to start within the 10 minutes after the flag-off. The Participants will be disqualified when they do not start as per their specified start time. Risks associated with the failure to start condition or Did Not Start DNS shall be the full responsibility of the Participants. If the Participants are forcing their participation by running on the Race route, the Race Organizer reserves the right to revoke the Participants’ bib number and rights to the facility along the Race route. In order to regulate the Race’s implementation, the Race Organizer will regulate the Event’s implementation at the start area with zoning. The Participants’ zoning will be organized automatically using the system as per the provision when the Participants fill the Registration Form. All Participants shall obey their start position within the assigned zone. The Race Organizer reserves the right to restrict the Cut Off Time COT and Cut Off Point COP. The time restriction or can be modified either forward or backward based on the Race Organizer’s considerations if deemed needed. Any modification in the time restriction can be done before or during the Race Day as per the special considerations and significant as per the above point 4. The Participants who are not reached the Cut Off Point COP specifically for 21K Half Marathon category and not recorded in the timing system at the finish line before the specified Cut Off Time COT will be considered as not finishing the Race or Did Not Finished, as per the following details Cut Off Point COP is the minimum time limit that shall be reached by Half Marathon Participants in a location within the Race route. In the 21K category Half Marathon Pontianak City Run, the Participants shall reach the KM 15 point within 3 hours after the start. The Participants who are not reached the Cut Off Point time restriction will be stopped by the Race Organizer and at the same time will be escorted using a vehicle until the Race Village. Cut Off Time COT is the longest time for the Race Participants to complete the travel distance, or to reach the finish line. Cut Off Time for each race category is as following Category Cut Off Time 21K Half Marathon 240 minutes atau 4 Hours 5K Open 80 minutes 5K Students 80 minutes 1K Kids 60 minutes The Participants who reach the finish line after the Cut Off Time COT will be decided as Over Cut Off Time. Check points will be placed at the start/finish line, and at the assigned time period to ensure that all Participants are respecting the official Race course. The Participants who fail to respect the official Race course will be disqualified from the Race. The Participants who are not finishing the Race and bringing the complete check point ribbon until the finish line and outside of the COT time limit are not entitled to receive the Finisher Medal. The Participants who are not wearing or bringing their BIB are not allowed to run and/or be on the race track. The Participants should take good care of their BIB and use it during the course of the Event and Race, placing the BIB in a visible position during the Race. The Participants are not entitled for any BIB replacement due to any damage or loss of the provided BIB for any particular reason. The Participants who win the Race “Winner“ shall wear the timing chip and BIB number pinned or placed properly during the Race. The Winner shall provide evidence of identification to receive the prize. The Participants are not allowed to smoke at the Race area whether in the race central or on the race track, starting from the time when the Participants enter the race area until up to when they leave the race area. The Participants are obligated to respect and appreciate other participants by not performing any misconduct which can cause inconvenience and provoke disturbance. The Participants are prohibited from using any supporting equipment for running, including bicycle, wheel chair, in-line skate, push caart, built in rolling shoes or other wheel-based objects which can accelerate the Runners step. The Participants are also prohibited from bringing baby and/or baby push cart during the Race. All Participants who are able to finish the Race within the specified time limit and below the Cut Off Time COT, will receive the Finisher Medal. EVENT MODIFICATION The Race Organizer reserves the right to modify the Event date with and for the basis of reasonable and fair considerations for the interest of the Event’s implementation and the Participants convenience within the reasonable time restriction for the distribution of information on the modification to the Participants and within the prevalent constraints. In the event that date modification has been announced either through email to the Participants and/or through social media and other information media, and the Participants are unable to participate on the modified date, then the Participants acknowledge that their non-participation is caused by their own condition and shall not burden any damage to the Race Organizer and other relevant party. The Race Organizer in reasonable and fair consideration and/or for the interest of the Race’s implementation and the convenient and security of the Participants reserves the right to modify the format of the Event within its policy or cancel the Event due to the circumstances beyond reasonable control excluding heavy rainfall, storm, or disaster, and demonstration. In the event that the Event shall be cancelled, the Race Organizer shall not be held responsible to refund any cost in full and to any damages caused by the cancellation. In the event that the Event is modified to other format, the Participants are not entitled to receive refund and there shall be no obligation arising from such modification. RACE ORGANIZER’S OBLIGATIONS/RESPONSIBILITIES Penyelenggara bertanggung jawab dalam batas kewajaran dan kelaziman untuk menjaga keberlangsungan Acara dan kenyamanan Peserta dalam menjalankan Acara sesuai dengan kelaziman. In any circumstances, the Race Organizer shall not be responsible to the Participants for any incident, accident, physical and medical injury, mistakes including negligence or losses on business, income or profit, savings or wasted expenses, lost or damages of the Participants’ personal equipment or any other damages whether directly or consequentially although the loss has been within the consideration of the parties on the date when the Registration Form is submitted which occur from the Participants when taking part of the Event or other issues which may arise as a result of this Terms and Conditions as well as for any loss amounting larger than the Registration Fee paid by the Participants. Notwithstanding, the Race Organizer and/or Race Management shall not be held responsible for any actions of the race audience/spectators or other third parties except as appointed differently. The Race Organizer will provide waiver letter form to the Participants for the Participants’ awareness and understanding on the risk assumption of this Event. The Participants to fill the form as per the specified requirements during the registration by ticking the relevant part of the form. With necessity, firm and cannot be made void by the Participants, for themselves or beneficiaries who are entitled to pursue legal action or claim against the Race Organizer, officials, employees, suppliers and/or sponsors and/or other parties considered responsible “Associates” as a result from any type of physical or mental losses, or other losses or damages including loss of income, profit or sickness and suffering being suffered by the Participants, directly or indirectly, or with family/or by dependents and caused by an event of any form associated with the Participants’ participation in the Event and the Participants undertake, for themselves or their beneficiaries who are entitled to compensate and release the Race Organizer and/or Race Management, and Associates from any cost and/or the amount that the claiment or one of the claimants need to pay as a result of the claim made by anyone. The Participants also agree to compensate the losses of the Race Organizer and the Associates for any claim, action, obligation or losses from the violation made by the Participants for and/or other negligence and/or mistakes which are intentional. RIGHTS ON PUBLICATION MATERIAL For the purpose of documentation, publication of documentation, and/or utilization of documentation of Pontianak City Run-Half Marathon 2020, the Participants understand that as a consequence of their participation, the Participants are not able to cancel and agree to Appear in the Event being filmed, recorded, broatcasted and explored in whole or in part in television program, film, video or broadcast of any form with any method and in any media and format, applies on or made after the date of this Provision, and The use and reproduction of the Participants’ name, resemblance and photographs, film and recording with any mean and in any media for the purpose of advertisements, publicity and other purpose in relation to the exploration of the Event and any event in the future and/or the Event’s promotion and any event in the future and commercial rights associated with the Event and any event in the future, as far as the usage is not showing direct support from the Participants from each official sponsor or Event supporter. Any film, photograph with camera or mobile phone, or other recording of moving or still images, and all associated intelectual properties including but not limited to copyright shall remain the ownership of the Race Organizer, and where the intelectual property is not automatically related to the Race Organizer, this Provision is legally binding and the Participants shall sign all reasonable documents needed for this purpose. As such, all the recordings will not be used other than for personal reason without the written consent from the Race Organizer. PRIZE AND RECOGNITION The Race Organizer will award a winning prize for each Race Winner as per the specified composition, category and class. The winning prize shall be tax deductable as per the applicable regulations. The winning prize will be provided via transfer within a maximum of three 3 working days after the Winner is considered valid and announced openly as the Winner. There shall be only one Winner for each race category, there shall be no same Winner for different race categories. If it is found that one of the same Participant wins in two or more categories, then the Participant’s participation in the Race will be considered void or cancelled and will automatically disqualified from receiving the winning prize. The scoring for the Winner is based on the Runner’s arrival time. Winner’s verification will be done based on the time record at check point based on the available check point timing system mat and check point ribbon or bracelet which is received by the Runner in full on each check point within the route. The decision from the jury is absolute and inviolable. DISQUALIFICATION AND DISPUTE ON RACE RESULT The Participants will not object on the Race Organizer’s decision to disqualify the Participants should they violates part or the whole finisher’s and/or podium’s disqualification regulations. The Participant’s data not recorded in the time recording equipment, the Participants not wearing the BIB according to their personal data, manipulating participation data, wearing other Participant’s BIB, not wearing the chip distributed by the Race Organizer, not wearing the check-point markings being distributed throughout the race route in full as per the race regulation, and the name of Participants is being registered in two or more race categories, and/or the name in the bib number is different from the official personal data; taking shortcuts, using any supporting equipment with or without wheel which can accelerate the Participantss’s steps; will result in the Participants’ disqualification for winning podium position and winner’s disqualification. Any dispute for podium position shall be raised by the Participants at the time and place of the Race, by following the dispute deposit rules and the deposit will only be returned if the dispute is won by the Participants who raised the dispute. RACE PACK COLLECTION Participants who have successfully completed the payment transaction are entitled to collect the Race Pack during the Race Pack Collection period as per the specified collection schedule. There will be no Race Pack Collection outside of the specified schedule, and the Race Organizer shall not be held responsible for the Participant’s delay in collecting the Race Pack. Participants are not allowed to change the size of jersey/shirt. If the Participants are unable to collect the Race Pack on their own, the Participants may produce a power of attorney for both parties duly signed on top of duty stamp to collect the Race Pack.
